Is my marriage even legal?!?

My husband and I got married at the beginning of 07. In Alaska you can appoint anyone by a judge to marry you. So we went to the courthouse and appointed one of our military friends to marry us. The man we had marry us just got his citizenship at a deployment ceremony the middle of 08. Is my marriage still legal since we were married by a non us citizen?? The reason I am asking is because I am going through a really nasty divorce and custody battle. And if my marriage isnt even legal in the first place then I wouldn't have to worry about the divorce and only focus on the custody battle. So if anyone has any sort of information on this it would be greatly appreciated. Thank you!
